Rule
Unless a category-specific duration applies elsewhere in the Residence Permits and Visas Regulation, a short-term residence permit is granted for 1 year on first application and 2 years on subsequent applications, with the exact term within that default influenced by the foreigner's request, its grounds, and other relevant matters.[1]
Exceptions
- This is the DEFAULT that applies only where no more specific Article 14(2) category duration governs (property-linked, non-owner, pensioner, humanitarian and other named categories each set their own duration, covered by separate Rules).
- Does not establish how much discretion 'the foreigner's request, its grounds, and other matters' actually gives an officer in practice.
