Rule
Where a dwelling's title is divided into multiple shares and one shareholder has already obtained a short-term residence permit through it, another shareholder is generally not granted the same permit for the same dwelling. The exception: if that first shareholder's short-term permit has not yet produced any derived family residence permit, a second shareholder may still qualify for their own short-term permit through the same dwelling. Where this exception is used and the same dwelling supports more than one short-term residence permit, none of those permits may be used as the basis for a family residence permit.[1][2]
Exceptions
- This Rule states the shared-title exception exactly as the regulation provides it — do not read it as 'only one shareholder can ever obtain residence from the same dwelling'; the exception and its consequence (no family-permit derivation once used) are integral, not a simplification.
