When unauthorised presence begins, and the grace periods that delay it

Rule record · last verified 22 September 2026

In force. Start date not confirmed in this record.

Rule

A foreigner is treated as unauthorised from the moment their lawful permission expires without renewal. Specific grace periods delay this: 40 days to apply for a new permit after a residence-exemption-triggering circumstance ends; 40 days of continued lawful presence after a work/business permit expires or is cancelled; 60 days of continued lawful presence after a student permit-holder defers or interrupts study; 60 days of continued lawful presence after graduating. Separate exemptions exist for documented legal detention, a court-ordered travel ban, or a documented inability to travel for health reasons.[1]

Exceptions

  • MATERIAL GAP: this Rule states only the trigger conditions and grace periods. The Regulation itself delegates the actual fine amounts to the base Aliens and Immigration Law (Fasıl 105), which has not been fetched or read — this Rule does NOT state any fine amount.
  • Article 25(4)'s retroactive-permit provisions (2-year lookback, 3-year for a TRNC citizen's adult unmarried child) are a remedy/cure mechanism, not covered by this Rule.
