Rule
TRNC's Foreigners' Work Permits Law creates a distinct permit, the İş Kurma İzni (Business Establishment Permit), for foreign members of the Board of Directors and shareholders/partners of TRNC companies, separate from the ordinary employee work permit (Süreli Çalışma İzni). The requirement is triggered conjunctively: (a) an intent to reside in the TRNC beyond the entry-visa period, and (b) acting in the capacity of employer in the company. Neither formal appointment as a director alone, nor holding shares alone, meets this conjunctive test by itself — remuneration is not part of the statutory test in either direction.[1][2]
Exceptions
- This Rule states the statutory definition and trigger test only. It does NOT determine, and must not be read to determine, whether any specific person's conduct meets the 'acting in the capacity of employer' limb — that is addressed, with an explicit interpretation marker, by the separate rule iskurma-izni-active-unpaid-management-ncr-interpretation.
- Law Art. 12(2)'s delegation of further detail on the shareholder-specific case to regulation is only partly traced; a further implementing yönetmelik under Tüzük Art. 37 was not located.
