Rule
The Insurance Services Law does not require a TRNC insurance or reinsurance company's founders or shareholders to be TRNC citizens. Founder/shareholder conditions are fit-and-proper criteria (no serious criminal record, not bankrupt, financial power/reputation) applied equally; for founders who are not TRNC citizens and/or not resident in the TRNC, the law's own text states that the legislation of their home country is additionally taken into account. A foreign insurance/reinsurance company may also open a TRNC branch directly, subject to a permission regime (minimum capital, not banned/restricted at home, home-country-approved articles) rather than a requirement to incorporate locally with TRNC-citizen ownership; the branch manager specifically must be TRNC-resident.[1]
Exceptions
- This Rule addresses the INSURANCE COMPANY (underwriting) layer only — Articles 12-14. It does NOT apply to insurance AGENTS (acente): a separate, explicit TRNC-citizenship requirement for agency founders/shareholders exists at that layer — see insurance-agent-trnc-citizen-shareholder-requirement. Do not generalise this finding across the whole insurance sector.
- This is a NEGATIVE finding for the company layer specifically: no TRNC-citizenship restriction was found in Articles 12-20, read in full for this question. It is not proof no such restriction exists anywhere in the Law's remaining articles or its delegated tüzükler/genelgeler.
