Rule
Where none of the Residence Permits and Visas Regulation's other categories apply, and in the assessing officer's opinion the foreigner would face humanitarian hardship if refused, a short-term residence permit of up to 1 year may be granted. The applicant must already be lawfully present in the country at the time of application. A Humanitarian Residence Permit holder is not eligible to act as a sponsor for a family residence permit.[1]
Exceptions
- This provision carries amendment markers to A.E.88/2020, A.E.350/2021 and A.E.784/2026 — not individually re-traced article-by-article for this Rule.
- Does not establish what evidence or process an applicant must follow to demonstrate 'humanitarian hardship', nor how the 'lawfully present at application' condition interacts with someone whose only lawful presence is about to expire.
- Not to be confused with refugee/asylum status — a different legal regime, addressed by NCR's existing Rule on the repealed UNHCR-document exemption.
