A distinct constitutional nationalization power names foreign-owned property

Rule record · last verified 22 September 2026

In force. Start date not confirmed in this record.

Rule

TRNC's Constitution contains a distinct nationalization provision, Article 43, that explicitly names foreign-owned movable and immovable property, alongside public-service enterprises, as a category the State may nationalize with compensation — separate from ordinary expropriation under Article 41.[1]

Exceptions

  • No data was found on whether Article 43 has ever actually been invoked against a foreign investor. This is a feature of the constitutional text, not evidence of actual practice or risk likelihood, and must be presented factually and neutrally.
