Rule
Unpaid common-expense debts, once court-established, can be registered as a priority charge against a unit at the District Land Registry — a genuine due-diligence risk for a buyer of resale property.[1]
Exceptions
- Confirms the legal mechanism exists. Does not establish how commonly this occurs in practice, nor whether a standard encumbrance search at the Land Registry would reliably surface such a memorandum before purchase — that practical due-diligence question was not separately researched.
