Building insurance is an owners'-assembly decision, not an automatic legal requirement

Rule record · last verified 20 September 2026

In force. Start date not confirmed in this record.

Rule

Insuring a shared building is a decision the owners' assembly makes (Article 23(1)), not an automatic legal requirement — corroborating a prior finding from the general Insurance Services Law with a more directly on-point primary source.[1]

Exceptions

  • Confirms the general position clearly. Does not establish whether any SPECIFIC development's own management plan (a binding contract) makes insurance mandatory for that site specifically — this would need to be checked plan-by-plan, not assumed uniform.
